How to Enter

To enter, individuals must complete the official entry form (found in Australian Reinforcing Company Service Centres), including by providing their first name, last name, address, valid email address, telephone number, selecting what prize draw group they would like to enter (from the list of prize draw groups on the entry form) and place the completed entry form in the entry box provided in the centre during the promotional period.

Terms and Conditions

1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. Entry is only open to Australian residents aged 18 years or over. Individuals who nominate a Racing Experience Prize on their entry form must hold a current valid driver’s licence issued in an Australian State or Territory.

3. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

4. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

5. Incomplete, indecipherable or illegible entries will be deemed invalid.

6. Only one entry permitted per person.

7. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

8. Promotion commences on 19/07/10. Entries close at 12noon on 20/08/10. The draw will take place at the Australian Reinforcing Company, 380 Docklands Drive, Docklands VIC 3008 on 27/08/10 at 12noon. The Promoter reserves the right to draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.

9. Winners will be notified by email, mail and telephone and the winners’ names will be published in The Australian on 01/09/10.

10. The Promoter’s decision is final and no correspondence will be entered into.

11. Entries will be divided into nine (9) separate prize draw groups, on the basis of the prize draw group the entrant nominates at the point of entry. The first valid entry drawn from each group will win the prize for that group. Entrants can nominate any one (1) of the following nine (9) prizes draw groups:

12. Any ancillary costs associated with redeeming the Red Balloon or the Flight Centre vouchers are not included. Redemption of the vouchers is subject to any terms and conditions of the issuer including those specified on the vouchers.

13. The Flight Centre vouchers are redeemable with participating Flight Centre Limited Stores, within Australia. Not redeemable for cash or travellers cheques. The voucher expires twelve months from the date of issue. Any unused balance of the voucher (by the expiry date) will not be awarded as cash and will be forfeited. Where the cost of purchase exceeds the available voucher balance, the voucher holder will be required to make up the difference between the purchase price and the Flight Centre gift voucher balance. Participating Flight Centre stores may not accept the voucher on a sale under $20. Flight Centre vouchers cannot be used for payment of credit or retailer accounts. Lost or stolen Flight Centre vouchers will not be replaced.

14. Red Balloon vouchers are exchangeable for credit to use towards purchasing an alternative Red Balloon experience, subject to the following conditions: (a) exchanges are only permitted for valid experience vouchers that have not been used; (b) vouchers may only be exchanged once without attracting a fee and all subsequent valid exchanges will incur an administration fee of $10 per voucher; (c) if a voucher is exchange for an experience of a lesser value, any remaining balance of the voucher will be held in credit on the voucher holder’s Red Balloon account; (d) if the voucher holder exchanges the voucher for an experience of higher value, they will be required and prompted to pay the difference; and (e) the credit that the voucher is exchanged for will have the same expiry date as the original voucher. All valid and unused Red Balloon gift vouchers are fully transferable. Experience vouchers must be used (date booked and experience taken) within six months of purchase of the voucher, as specified on the voucher. Extensions on the validity of the experience gift vouchers may be permitted, subject to the conditions specified on the Red Balloon website (including additional fees). Certain experiences may be subject to minimum age, weight, health or other restrictions. Once a booking for an experience has been made, cancelations by the voucher holder may incur a cancellation fee. In addition, in case of short notice cancelation the voucher holder may forfeit their voucher completely.

15. The winner of the Turbo Rally Driving Taster Voucher and the Sports Car Sampler Ultimate Drive Day Voucher (“Racing Experience Prizes”) must hold a current valid driver’s licence issued in an Australian State or Territory and acknowledges that motor racing is a dangerous activity, which may result in injury or death, and participates at his/her own risk. Prize is subject to booking availability. Red Balloon Day will provide the Racing Experience Prize (“Prize Supplier”). Winner (a) must attend, undergo and pass any appropriate training, briefings, safety demonstrations, required medical tests and other requirements (including blood alcohol testing) of the Promoter and the Prize Supplier as determined by them in their absolute discretion; (b) must declare to the Promoter or the Prize Supplier any health-related issues that may affect his/her safe participation in the Racing Experience Prize and obtain a written clearance from their doctor in this respect; (c) must not have any heart condition or history thereof, or other medical conditions that would make it dangerous to participate in the Racing Experience Prize; (d) must not be under the influence of any drugs or alcohol; (e) must comply with all directions of the Promoter, the Prize Supplier, the nominated driver and race officials; and (f) must wear all safety and other equipment required. The Promoter and the Prize Supplier in their absolute discretion (a) will nominate a qualified driver; (b) reserve the right to refuse to allow the winner to take part in any or all aspects of the Racing Experience Prize if they reasonably believe the winner poses a safety risk or for any other reason; (c) may cancel the Racing Experience Prize if the conditions are deemed dangerous. If the Racing Experience Prize is varied for any reason beyond the control of the Promoter it may not be rescheduled and in which case, no compensation will be offered.

16. The Winners of the selected Red Balloon Voucher prizes (i.e. prize numbers 1, 3, 4 and 8 above) that are redeemable for the specified experience (“Activity”) acknowledge that the Activity is a dangerous activity that may result in injury or death, and participate at their own risk. Winners must: (a) attend, undergo and pass any appropriate training, briefings, required medical tests and other requirements of the Promoter and Activity organisers as determined by them in their absolute discretion; (b) not have any heart condition or history thereof, or other medical conditions that would make it dangerous to participate in the Activity; (c) not be under the influence of drugs or alcohol; (d) comply with all directions of the Promoter and Activity organisers at all times; and (e) wear all safety and other equipment required. The Promoter and Activity organisers, in their absolute discretion, at all times reserve the right to: (a) prevent any winner from participating in the Activity if, at any time, they reasonably believe that the winner poses a safety risk or for any other reason; and/or (b) cancel the Activity if the conditions are deemed dangerous. Prize is subject to booking availability. If the Activity is varied for any reason beyond the control of the Promoter it may not be rescheduled and no compensation will be offered.

17. Subject to the unclaimed prize draw clause, if for any reason a winner does not redeem a prize or an element of a prize by the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited.

18. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

19. Total prize pool value is $18,749.

20. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

21. A draw for any unclaimed prizes may take place on 30/11/2010 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners will be notified by email, mail and telephone and Winners’ their names will be published in The Australian on 07/12/10.

22. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

23. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

24. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

25. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of/taking of a prize.

26. As a condition of accepting a prize, the winner (and any companion) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

27. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
